It is a common mistake to expect the rules that apply to UK Nationals working in the UK, apply to UK Nationals working elsewhere.
Many countries within the EMEA now operate a strict interpretation of the OECD Double Taxation Treaty model, which means that taxation is usually payable to the local tax authority of the country in which you are working from the moment the services to the end client are provided and not after 183 days.
The agreements for National Insurance / Social Security contributions also confirm that unless exemption is provided by the home country, being the country they have been posted from and normally live (habitually resident), that local Social contributions are normally due.
It is also a simple fact that a standard PSC (Personal Service Company) is no longer the preferred or accepted method of operating whilst on assignment in Europe / the EEA.
Our main Employment Management Business (I-PAYE Limited) has successfully set up local PAYE (Withholding) schemes in a number of jurisdictions that enable the payment of Income Tax. In addition we have recruited the assistance of local tax advisers in other countries to add to our own expertise.
Each country has a unique set of rules and it imperative that specific advice is sought before departure, and ongoing advice is given until your return. Ignorance of the local laws or simply ignoring them could lead to interest, penalties and levies being charged in addition to collection of any underpayment.
